T4 Incorrect - Advice? Native Status Exempt

I received my Indian status back in January 2024. I had to apply for a new status card which took awhile, so I never informed payroll because I figured I’ll just continue to pay taxes and get a refund. I resigned from my position in January of this year - before resigning I had HR fill out the TD1-IN form. I received my T4 but it doesn’t show that I’m exempt, I assume HR never forwarded the form to Payroll. What are my options? Can I file without Payroll correcting it? Can I submit the form myself? Thank you.

Get it dealt with by your employer and have an amended T4 prepared.
They will obviously leave the source deductions as they were but should update Box 14 and 71 accordingly.

Edit: I assumed it was for work on reserve?

Ditto @Arliss, but just to clarify - the TD1 forms are required to be filled out and signed by YOU (the employee), not your employer or HR dept. If you didn’t sign it, they don’t have to accept it. Not saying they CAN’T accept it, but if they didn’t change your payroll info, that may be the reason.

I did fill out the TD-1 form when I first got hired, the TD1-IN is Determination of Exemption of an Indian’s Employment Income which the employee is required to sign as well.

The employer wrote back when I asked to amend my T4:

“The TD1-IN form is to stop tax from being deducted from your paycheque while employed. For T4 purposes, we must report all taxes and statutory deductions taken.”

If your income was earned a a reserve, you should have an amount in Box 71 on your T4.

If they withheld deductions you will definitely want them reported on the T4.
Whether they should have been withholding them is another matter.

It would be the reporting of the income that differs.

I am begining to the think your employer may not be on reserve?

If that is the case it is a little trickier and the employer may need a little guidance. Good information here:

It sounds to me like the issue may be more about DATES. That is, the date that you obtained your Indian status and/or the date that you notified your employer. It might be best to talk to a lawyer, or your provincial labour board regarding the legal details. I don’t know the labour laws that well (even in my own province), but maybe the employer is not required to change your employee status retroactively - that is, if you didn’t fill out the TD1-IN form until Jan 2025, or if you DATED it as Jan 2025, it may be effective only GOING FORWARD.
