T1 With Limited Partner Business Income

We are filing a 2024 T1 late, and the client has a T5013 with Limited partnership business income reported in Box 104 of the T5013.

According to TI 2006-0183751E5, the filing due date is June 15; however, taxCycle indicates that the filing due date is April 30, and the spouse 's return does not have the “Self-employed” check box marked.

I am not sure if I am not entering the information correctly or if this is a programming error.

I suppose the software can’t know whether the business entity operating the Limited Partnership would be considered a “tax shelter” as defined by subsection 143.2(1) and excluded from the June 15th filing deadline imposed by clause 150(1)(d)(ii)(A).

Likely the software picks up its “filing deadline” from entries made on lines 13499 through 14299 of the T1 return. Since limited partnership business income flows to line 12200 of the T1 return that could explain why there is no mention of the June 15th filing deadline.

The Canada Revenue Agency determines what the filing deadline is for your client, likely using the same criteria (entries on lines 13499 through 142969). The software doesn’t transmit the filing deadline to the CRA.

If you are certain the limited partnership does not meet the definition of a “tax shelter” then you my be able to make an entry of 10.00 on line 13499 and 0.00 on line 13500 in an attempt to signal the client actually has business income and a June 15th filing deadline.

That’s an idea.

I was going to override the date to calculate the interest and check the self-employed box manually on the spouse’s return. I know there are several thousand of these similar returns across Canada and I would have though the software could handle this.

A Y/N beside the tax shelter number might be a fix.
