I have been trying to find answer… to no avail. so i thought i would reach out
i have a client that has primary residence and has other home co-owned with husband., His parents were living in the other other house and renting it from couple
they divorced and he moved into property with parents -
they are trying to assess the value for the wife for tax purposes and lawyer told her there was a tax free rollover because it was her husband
i am not familiar with this issue or if applicable rollover.
any advice would be appreciate.

My understanding is that it is considered a rental property (especially since it was actually being rented), at least up to the point he moves into it, and would be taxed accordingly.

Yes i need to have deemed disposition of rental property on date that ex husband moves into it.
the issue is that they are trying to defer the portion that she pays on her capital gain from that deemed disposition?
