If separation was in process as of 31st Dec for a couple, what would be the suggested marital status for their T1? Couple is still waiting for court order.
Once you have been separated for 90 days because of a breakdown in the relationship, the effective date of your separated status is the date you started living separate and apart. So, if you separated prior to December 31, 2023 and remained separated for 90 consecutive days, the status on your tax return for 2023 would be “separated”.

If they were still living together as of the end of December 31st, they will file as married. If they were living apart, then it would be the date one or both of them moved out as the date of separation, unless a formal separation agreement is listing a different date.
The key is if they were living together or not, as CRA won’t recongize them as separated unless they are living apart of have a formalized separation agreement with the courts.
