Non-resident claim CCA

Do you claim CCA for non-residents filing Sec 216, as their tax rate is the same whether they file it today or when the property is disposed of?

You can but be very careful if the property was ever their principal residence as claiming depreciation can interfere with that especially if a 45(2) election was filed at the date of departure. Claiming CCA invalidates the election. Most of mine don’t because they typically don’t have any profit to claim it against. They are renting while gone because they want to come back to their house but their expenses including interest are higher than the fair market rent they can get. I leave it up to the client if they have a profit and no principal residence concerns.
