CWB & Deemed Resident

I have a client who is a deemed resident – he comes in the Seasonal Agricultural Worker’s program from Guatemala. His spouse & children are back home. Can he claim the CWB? I’ve called CRA & have gotten different answers. Some say no because he was not physically present in Canada throughout the entire year, which is a requirement. Then I called again & they said yes he is eligible because being “physically present" does not matter because he’s already deemed a resident through the entire tax year. Next, they tell me to look at the 2025 Income Tax Package for deemed residents & non-resident & it DOES include schedule 6 as part of the package, but when I look at the CRA website under ‘Seasonal Agricultural Workers Program” it doesn’t have schedule 6 listed as a “requirement.” These are all paper filed, by the way. Anyone know the answer? I am frustrated. Thanks!

Have you checked out your Dedicated Telephone Service with CRA? You will need your personal 6 code.

Sometimes they excellent answers, but not always.

No, I did not check that. Thanks so much. …will definitely call!
